General Terms & Conditions
for the Use of the CryptoUnity Platform
These Terms of Service govern the use of services provided by CU Global Inc. (CryptoUnity), a corporation incorporated under the laws of the State of Delaware, United States, with its registered office at 131 Continental Dr, Suite 305, Newark, Delaware 19713, and its registered agent Legalinc Corporate Services Inc.
These Terms apply to users located in the United States and govern the use of the CryptoUnity Platform within jurisdictions where services are legally available.
These Terms of Service govern your access to and use of the CryptoUnity platform, including all related services, features, content, and functionality (the “Platform”).
PLEASE READ THESE TERMS CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, INCLUDING A MANDATORY ARBITRATION AGREEMENT AND CLASS ACTION WAIVER.
By accessing or using the Platform, you agree to these Terms and consent to the use of electronic records and signatures in accordance with applicable U.S. law.

1. Introduction And Acceptance
These Terms of Service (the “Terms”) govern your access to and use of the CryptoUnity platform, including the CryptoUnity website, mobile application, and all related services, features, content, and functionality (collectively, the “Platform”).
These Terms constitute a legally binding agreement between you (“User” or “you”) and CU Global Inc., a corporation incorporated under the laws of the State of Delaware, United States, with its registered office at 131 Continental Dr, Suite 305, Newark, Delaware 19713 (“CryptoUnity”, “we”, “us”, or “our”).
BY ACCESSING OR USING THE PLATFORM, CREATING AN ACCOUNT, OR OTHERWISE INDICATING YOUR ACCEPTANCE OF THESE TERMS, YOU REPRESENT AND WARRANT THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE PLATFORM.
YOU FURTHER ACKNOWLEDGE AND AGREE THAT THESE TERMS INCLUDE A MANDATORY ARBITRATION AGREEMENT AND A WAIVER OF CLASS ACTION RIGHTS, WHICH AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A CLAIM IN COURT OR PARTICIPATE IN A CLASS ACTION.
These Terms apply to all users of the Platform, including visitors, registered users, and any person accessing or interacting with the Platform in any manner.
You represent and warrant that:
(i) you are at least eighteen (18) years of age;
(ii) you have the full legal capacity and authority to enter into these Terms;
(iii) you are not located in, under the control of, or a resident of any jurisdiction subject to U.S. sanctions or restrictions; and
(iv) your use of the Platform does not violate any applicable law or regulation.
These Terms incorporate by reference the Privacy Policy, Cookie Policy, and any additional policies, disclosures, or documents referenced herein or otherwise made available through the Platform, each of which forms an integral part of these Terms.
CryptoUnity reserves the right, at its sole discretion, to modify, update, or replace these Terms at any time. Any such changes shall become effective immediately upon posting, unless otherwise required by applicable law. Your continued use of the Platform following such changes constitutes your acceptance of the revised Terms.
CryptoUnity may, at any time and without prior notice, suspend, restrict, or terminate your access to the Platform, in whole or in part, for any reason, including but not limited to compliance with applicable laws, regulatory requirements, or internal risk policies.
You agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.
YOU HEREBY IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE PLATFORM, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
2. Nature Of The Platform
CryptoUnity operates solely as a technology platform that provides users with access to services offered by independent third-party providers, including but not limited to BitGo Technologies LLC and its affiliates (“BitGo”).
CRYPTOUNITY DOES NOT PROVIDE, OFFER, OR PERFORM ANY REGULATED FINANCIAL, INVESTMENT, BROKERAGE, DEALER, EXCHANGE, OR CUSTODIAL SERVICES.
CryptoUnity is not a broker, dealer, exchange, execution venue, order matching system, financial institution, investment adviser, or money transmitter, and is not registered with the U.S. Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), or any state financial regulatory authority.
CryptoUnity does not hold, receive, or control user funds or digital assets, does not execute transactions on behalf of users, does not determine execution prices, spreads, or liquidity sources, and does not act as a counterparty to any transaction.
All transactions, including but not limited to the custody of assets, execution of trades, processing of fiat payments, and settlement of transactions, are performed exclusively by third-party service providers, including BitGo, acting in their own capacity and under their own regulatory frameworks.
CryptoUnity provides a user interface through which users may:
(i) access third-party services;
(ii) view account, transaction, and portfolio information;
(iii) access educational and informational content; and
(iv) interact with customer support services.
CryptoUnity does not control, direct, or influence the execution, timing, pricing, or outcome of any transaction performed by third-party providers.
All decisions to enter into transactions or engage in any financial activity are made solely by the user. You acknowledge and agree that you are solely responsible for evaluating the risks associated with any transaction.
CRYPTOUNITY DOES NOT PROVIDE ANY FORM OF INVESTMENT, FINANCIAL, LEGAL, OR TAX ADVICE, AND NOTHING ON THE PLATFORM CONSTITUTES A RECOMMENDATION, SOLICITATION, OR OFFER TO BUY, SELL, OR HOLD ANY DIGITAL ASSET OR SECURITY.
CryptoUnity does not alter, manipulate, or interfere with user instructions, orders, or communications submitted to third-party providers.
CryptoUnity is solely responsible for the operation, maintenance, and technical functionality of the Platform and shall not be responsible for the performance, availability, accuracy, or outcomes of any third-party services.
WITHOUT LIMITING THE FOREGOING, CRYPTOUNITY DOES NOT OFFER OR SELL SECURITIES, DOES NOT FACILITATE THE OFFERING OF SECURITIES, AND DOES NOT PROVIDE ANY SERVICES THAT WOULD REQUIRE REGISTRATION UNDER U.S. SECURITIES LAWS.
SERVICES ACCESSIBLE THROUGH THE PLATFORM ARE AVAILABLE ONLY IN U.S. STATES AND JURISDICTIONS WHERE SUCH SERVICES MAY BE LAWFULLY PROVIDED BY THE RELEVANT THIRD-PARTY SERVICE PROVIDER, INCLUDING BITGO. AVAILABILITY MAY BE RESTRICTED OR LIMITED WITHOUT NOTICE BASED ON REGULATORY, LICENSING, OR COMPLIANCE REQUIREMENTS.
CRYPTOUNITY DOES NOT GUARANTEE THE AVAILABILITY OF ANY SERVICES IN ANY PARTICULAR JURISDICTION AND RESERVES THE RIGHT TO RESTRICT ACCESS BASED ON GEOGRAPHIC LOCATION, RESIDENCY, OR REGULATORY STATUS.
THE PLATFORM MAY BE SUBJECT TO U.S. EXPORT CONTROL AND SANCTIONS LAWS, INCLUDING REGULATIONS ADMINISTERED BY THE U.S. DEPARTMENT OF THE TREASURY’S OFFICE OF FOREIGN ASSETS CONTROL (OFAC). YOU AGREE NOT TO ACCESS OR USE THE PLATFORM IN VIOLATION OF ANY SUCH LAWS OR REGULATIONS.
3. Third-Party Services (Bitgo)
CryptoUnity acts solely as a technology platform and introducer enabling users to access services provided by independent third-party service providers, including BitGo Technologies LLC and its affiliates (“BitGo”).
ALL DIGITAL ASSET SERVICES, INCLUDING BUT NOT LIMITED TO CUSTODY, TRANSACTION EXECUTION, FIAT PROCESSING, ORDER ROUTING, AND SETTLEMENT, ARE PROVIDED EXCLUSIVELY BY BITGO OR ITS AFFILIATES.
BitGo Technologies LLC is registered with the Financial Crimes Enforcement Network (FinCEN) as a Money Services Business and holds money transmitter licenses in certain U.S. states, with additional licenses pending.
CryptoUnity does not provide any regulated financial services and is not licensed as a money transmitter, broker-dealer, exchange, or financial institution in the United States.
By accessing or using services provided by BitGo, you enter into a direct contractual relationship with BitGo, which is governed exclusively by BitGo’s applicable agreements, including but not limited to:
(i) the BitGo Custody Service Agreement (CSA);
(ii) the BitGo Electronic Trading Agreement; and
(iii) the BitGo Master Purchase Agreement (MPA).
CryptoUnity is not a party to any such agreements and shall have no responsibility or liability arising from or relating to such agreements.
CryptoUnity does not control, operate, or guarantee BitGo services, including their availability, execution, timing, accuracy, or outcomes.
ALL TRANSACTIONS ARE EXECUTED BY BITGO, WHICH ACTS AS PRINCIPAL AND COUNTERPARTY TO YOUR TRANSACTIONS. CRYPTOUNITY DOES NOT ACT AS YOUR AGENT, BROKER, FIDUCIARY, OR REPRESENTATIVE.
CryptoUnity does not hold, access, or control any user digital assets or fiat funds and does not have access to private keys, wallets, or custody infrastructure.
Digital assets held in custody by BitGo remain the property of the user at all times and may be held in omnibus wallets, with ownership tracked through internal ledger systems maintained by BitGo.
CryptoUnity does not maintain custody accounts, does not segregate assets, and does not maintain any ownership records of digital assets.
Third-party providers, including BitGo, may rely on subcontractors, banking partners, liquidity providers, or affiliates in the provision of their services.
CryptoUnity shall not be responsible for any acts, omissions, errors, delays, or failures of any third-party provider, including BitGo.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY DISCLAIMS ALL LIABILITY ARISING FROM OR RELATED TO ANY THIRD-PARTY SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF FUNDS, FAILED TRANSACTIONS, DELAYS, OR SERVICE INTERRUPTIONS.
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THIRD-PARTY SERVICES IS AT YOUR SOLE RISK.
SERVICES PROVIDED BY BITGO MAY ONLY BE AVAILABLE IN U.S. STATES OR JURISDICTIONS WHERE BITGO IS LICENSED OR OTHERWISE AUTHORIZED TO OPERATE. AVAILABILITY MAY CHANGE AT ANY TIME WITHOUT NOTICE.
CRYPTOUNITY DOES NOT GUARANTEE SERVICE AVAILABILITY IN ANY PARTICULAR STATE OR JURISDICTION.
IF YOU ARE LOCATED IN A STATE OR JURISDICTION WHERE SUCH SERVICES ARE NOT PERMITTED, YOU MUST NOT ACCESS OR USE SUCH SERVICES.
3.1 Regulatory Status
CryptoUnity is not a licensed financial institution, money transmitter, broker-dealer, exchange, investment adviser, or custodian in the United States and does not provide any regulated financial or digital asset services.
CryptoUnity is not registered with the U.S. Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), or any state financial regulatory authority.
All regulated services accessible through the Platform are provided exclusively by third-party providers, including BitGo Technologies LLC and its affiliates (“BitGo”).
BitGo Technologies LLC is registered with the U.S. Financial Crimes Enforcement Network (FinCEN) as a Money Services Business (MSB) and holds money transmitter licenses in certain U.S. states, with additional licenses pending or under review.
Such services may include, without limitation:
(i) custody and administration of digital assets;
(ii) exchange of digital assets for fiat or other digital assets;
(iii) execution of transactions and order routing; and
(iv) fiat payment processing and settlement.
CryptoUnity does not perform any of the above services and provides access to such services solely as a technology interface.
BitGo operates independently of CryptoUnity and is solely responsible for regulatory compliance, licensing, custody of assets, transaction execution, and financial operations.
CryptoUnity does not supervise, control, or assume responsibility for BitGo’s regulatory status, compliance obligations, or licensing scope.
SERVICES MAY ONLY BE AVAILABLE IN U.S. STATES OR JURISDICTIONS WHERE BITGO IS LICENSED OR OTHERWISE AUTHORIZED TO OPERATE. AVAILABILITY MAY BE RESTRICTED, LIMITED, OR TERMINATED AT ANY TIME WITHOUT NOTICE BASED ON LEGAL OR REGULATORY REQUIREMENTS.
CryptoUnity does not guarantee that any services will be available in your jurisdiction and shall not be liable for any inability to access services due to regulatory restrictions.
NOTHING ON THE PLATFORM CONSTITUTES AN OFFER, SOLICITATION, OR SALE OF SECURITIES, NOR DOES CRYPTOUNITY FACILITATE THE OFFERING OF SECURITIES UNDER U.S. LAW.
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE PLATFORM AND ANY THIRD-PARTY SERVICES IS SUBJECT TO APPLICABLE FEDERAL AND STATE LAWS, INCLUDING BUT NOT LIMITED TO ANTI-MONEY LAUNDERING (AML), KNOW-YOUR-CUSTOMER (KYC), AND SANCTIONS REGULATIONS.
CRYPTOUNITY DISCLAIMS ALL LIABILITY ARISING FROM OR RELATED TO THE REGULATORY STATUS, LICENSING, OR COMPLIANCE OF ANY THIRD-PARTY PROVIDER.
3.2 No Financial Or Investment Services
CryptoUnity is not a bank, money transmitter, payment institution, broker-dealer, exchange, investment adviser, or financial institution of any kind.
CRYPTOUNITY DOES NOT PROVIDE INVESTMENT SERVICES, INVESTMENT ADVICE, PORTFOLIO MANAGEMENT, OR ANY FORM OF FINANCIAL, LEGAL, OR TAX ADVICE.
ALL INFORMATION, CONTENT, MATERIALS, FEATURES, AND FUNCTIONALITIES MADE AVAILABLE ON THE PLATFORM ARE PROVIDED SOLELY FOR INFORMATIONAL AND EDUCATIONAL PURPOSES.
NOTHING ON THE PLATFORM CONSTITUTES:
(i) INVESTMENT ADVICE;
(ii) A RECOMMENDATION OR ENDORSEMENT;
(iii) AN OFFER, SOLICITATION, OR INVITATION TO BUY, SELL, OR HOLD ANY DIGITAL ASSET OR SECURITY; OR
(iv) ANY FORM OF FINANCIAL PROMOTION UNDER APPLICABLE LAW.
CRYPTOUNITY DOES NOT OFFER, SELL, OR FACILITATE THE OFFERING OF SECURITIES AND DOES NOT PROVIDE ANY SERVICES THAT WOULD REQUIRE REGISTRATION UNDER U.S. SECURITIES LAWS.
ANY DECISIONS MADE BASED ON INFORMATION PROVIDED THROUGH THE PLATFORM ARE MADE SOLELY AT YOUR OWN RISK.
YOU ARE SOLELY RESPONSIBLE FOR EVALUATING WHETHER ANY TRANSACTION OR ACTIVITY IS APPROPRIATE FOR YOU BASED ON YOUR PERSONAL CIRCUMSTANCES, FINANCIAL SITUATION, INVESTMENT OBJECTIVES, EXPERIENCE, AND RISK TOLERANCE.
CRYPTOUNITY DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED THROUGH THE PLATFORM AND DISCLAIMS ALL LIABILITY ARISING FROM ANY RELIANCE ON SUCH INFORMATION.
CRYPTOUNITY DOES NOT SUPPORT, ENDORSE, OR FACILITATE THE OFFERING OF ANY DIGITAL ASSET THAT CONSTITUTES A SECURITY UNDER APPLICABLE LAW.
YOU ACKNOWLEDGE AND AGREE THAT DIGITAL ASSETS ARE HIGHLY VOLATILE, SPECULATIVE, AND MAY RESULT IN THE LOSS OF ALL VALUE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY SHALL NOT BE LIABLE FOR ANY LOSSES INCURRED AS A RESULT OF YOUR RELIANCE ON ANY INFORMATION OR CONTENT MADE AVAILABLE THROUGH THE PLATFORM.
3.3 Fiat And Payment Services
CryptoUnity does not process, receive, hold, safeguard, or control fiat funds on behalf of users.
ALL FIAT-RELATED SERVICES, INCLUDING BUT NOT LIMITED TO DEPOSITS, WITHDRAWALS, PAYMENT PROCESSING, AND SETTLEMENT, ARE PROVIDED EXCLUSIVELY BY THIRD-PARTY SERVICE PROVIDERS, INCLUDING BITGO TECHNOLOGIES LLC AND ITS BANKING OR PAYMENT PARTNERS.
CryptoUnity is not a money transmitter, payment processor, bank, or financial institution and is not licensed under any U.S. federal or state payment services laws.
CryptoUnity does not operate, manage, or control any bank accounts, payment infrastructure, or fiat custody mechanisms and does not have access to user fiat funds at any time.
All fiat transactions are subject to the terms, conditions, processing times, compliance procedures, and operational rules of the applicable third-party service provider.
CryptoUnity does not guarantee the availability, timing, execution, or success of any fiat transaction and shall not be responsible for any delays, failures, reversals, rejections, or errors caused by third-party providers.
YOU ACKNOWLEDGE AND AGREE THAT ALL FIAT TRANSACTIONS ARE PROCESSED ENTIRELY OUTSIDE THE CONTROL OF CRYPTOUNITY AND ARE SUBJECT TO APPLICABLE BANKING, PAYMENT, AML, KYC, AND REGULATORY REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY DISCLAIMS ALL LIABILITY ARISING FROM OR RELATED TO ANY FIAT TRANSACTIONS, INCLUDING BUT NOT LIMITED TO LOSS OF FUNDS, DELAYS, FAILED PAYMENTS, OR THIRD-PARTY ERRORS.
IF YOU ARE LOCATED IN A JURISDICTION WHERE FIAT SERVICES ARE NOT PERMITTED OR AVAILABLE, YOU MUST NOT ATTEMPT TO USE SUCH SERVICES.
4. User Account, Registration And Verification
Access to digital asset and related services is conditional upon your acceptance of the applicable agreements of third-party providers, including BitGo. Without such acceptance, you will not be permitted to access or use such services.
4.1 Account Registration
In order to use the Platform, you must create an account and provide accurate, complete, and up-to-date information at all times.
By creating an account, you represent and warrant that:
(i) you are at least eighteen (18) years of age;
(ii) you are acting on your own behalf and not on behalf of any third party unless expressly authorized;
(iii) you have full legal capacity and authority to enter into these Terms;
(iv) you are not located in, organized under the laws of, or a resident of any jurisdiction subject to U.S. sanctions or embargoes, including those administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC); and
(v) your use of the Platform complies with all applicable federal, state, and local laws and regulations.
You may create and maintain only one account. CryptoUnity reserves the right, at its sole discretion, to reject any registration, or to suspend, restrict, or terminate any account at any time, with or without notice, for any reason.
4.2 Account Security
You are solely responsible for maintaining the confidentiality and security of your login credentials, authentication methods, devices, and account access.
You are fully responsible for all activities conducted through your account, whether authorized or unauthorized, except where required by applicable law.
You must notify CryptoUnity immediately of any unauthorized access, suspected unauthorized use, or security breach affecting your account.
You acknowledge and agree that all instructions, actions, and requests submitted through your account credentials, authentication methods, or authenticated devices shall be deemed valid, binding, and authorized.
If your credentials, device, or authentication method are lost, stolen, compromised, or used without authorization, you must notify CryptoUnity immediately. You remain responsible for all actions taken prior to such notification.
Certain actions and transactions may require authentication through security procedures defined by third-party providers, including BitGo.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR UNAUTHORIZED ACTIVITY RESULTING FROM YOUR FAILURE TO MAINTAIN ADEQUATE SECURITY.
4.3 Two-Factor Authentication (2FA)
You may be required to enable and maintain two-factor authentication (2FA) or other security measures in order to access certain features of the Platform or perform specific transactions.
Failure to comply with required security measures may result in restricted, suspended, or terminated access to the Platform.
4.4 Identity Verification (KYC) and Compliance
Access to certain services is subject to successful completion of identity verification, compliance checks, and onboarding procedures conducted by CryptoUnity, BitGo, or other authorized third-party providers.
You agree to:
(i) provide accurate, complete, and up-to-date information;
(ii) submit all requested identification documents;
(iii) cooperate fully with any verification, compliance, or due diligence requests; and
(iv) promptly update any information that becomes inaccurate or outdated.
CryptoUnity and/or third-party providers may request additional information or documentation at any time, and may delay, reject, or deny verification at their sole discretion.
Failure to complete identity verification may result in limited, suspended, or no access to services.
You authorize CryptoUnity, its service providers, and relevant third parties to access, process, and transmit your information for the purposes of identity verification, fraud prevention, AML, CTF, sanctions compliance, and regulatory obligations.
CryptoUnity may record and retain evidence of your acceptance of agreements, including timestamps and related data, for audit, compliance, and regulatory purposes.
4.5 Monitoring and Compliance
Your account and activity may be monitored, analyzed, and reviewed for compliance with applicable laws, including anti-money laundering (AML), counter-terrorist financing (CTF), fraud prevention, and U.S. sanctions programs.
You agree to cooperate fully with any compliance-related requests, including requests relating to source of funds, transaction activity, or identity verification.
Failure to cooperate may result in account suspension, restriction, termination, or reporting to competent authorities.
4.6 Account Suspension and Termination
CryptoUnity may, at its sole discretion and without prior notice, suspend, restrict, or terminate your account for any reason, including but not limited to:
(i) violation of these Terms;
(ii) provision of false or misleading information;
(iii) suspected fraudulent, unlawful, or abusive activity;
(iv) regulatory or compliance requirements; or
(v) risk management considerations.
Access to services may also be restricted or suspended by third-party providers, and CryptoUnity shall not be responsible for such restrictions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY SHALL NOT BE LIABLE FOR ANY LOSSES ARISING FROM ACCOUNT SUSPENSION OR TERMINATION.
4.7 Account Closure by User
You may request to close your account at any time, subject to completion of any pending obligations, transactions, or compliance requirements.
You remain solely responsible for withdrawing any assets through applicable third-party providers prior to account closure.
4.8 Data Retention After Closure
CryptoUnity may retain your personal data and account-related information following account closure to the extent required by applicable laws, including anti-money laundering (AML) and other regulatory obligations.
4.9 Loss of Legal Capacity or Death
In the event of your death or loss of legal capacity, access to your account may be restricted.
CryptoUnity will handle such cases in accordance with applicable laws and based on valid legal documentation provided by authorized persons or competent authorities.
4.10 Electronic Communications and Consent
You consent to receive all communications, agreements, notices, disclosures, and records electronically.
Electronic communications shall have the same legal effect as if provided in writing, and you agree that electronic signatures are legally binding.
4.11 Indemnification
You agree to indemnify, defend, and hold harmless CryptoUnity, its affiliates, officers, directors, employees, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to:
(i) your use of the Platform;
(ii) your violation of these Terms;
(iii) your breach of any applicable law or regulation; or
(iv) your infringement of any rights of any third party.
5. Restrictions On Service Availability
The Platform may be accessible worldwide; however, access to certain features and services is restricted and may not be available in all jurisdictions.
You may use the Platform only if:
(i) you are located in a jurisdiction where such use is lawful; and
(ii) you are not subject to any sanctions, restrictions, or prohibitions under applicable laws, including those administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC).

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY SHALL NOT BE LIABLE FOR ANY LOSSES, DAMAGES, OR RESTRICTIONS ARISING FROM YOUR INABILITY TO ACCESS OR USE THE PLATFORM OR SERVICES IN ANY JURISDICTION.
6. Payments, Funding And Transactions
Transaction confirmations, receipts, statements, and other account-related information may be provided electronically by third-party providers, including BitGo, or made available through the Platform or via email. You consent to receiving all such information in electronic form.
Agreements, confirmations, and transaction records may be provided on a durable medium, including electronic formats such as PDF or in-app access, and shall have the same legal effect as written documents.
Account statements and records relating to digital assets and fiat transactions may be prepared and provided by third-party service providers, including BitGo, in accordance with applicable laws and their internal policies.
CryptoUnity does not process, execute, settle, or control any transactions. All transactions are executed, processed, and settled exclusively by third-party providers, including BitGo, under their respective agreements.
CryptoUnity does not hold, custody, or control any crypto-assets or fiat funds at any time.
Transactions may be subject to:
(i) verification, compliance, and risk checks;
(ii) delays, reversals, or rejections;
(iii) limits imposed by third-party providers; and
(iv) applicable legal and regulatory requirements.
Transactions cannot be executed if they would result in a negative balance. Credit, lending, margin trading, or similar services are not provided.
YOU ACKNOWLEDGE AND AGREE THAT ALL TRANSACTIONS ARE IRREVERSIBLE ONCE INITIATED OR EXECUTED, EXCEPT AS REQUIRED BY APPLICABLE LAW OR PERMITTED BY THE RELEVANT THIRD-PARTY PROVIDER.
CryptoUnity does not guarantee execution, settlement, timing, pricing, or availability of any transaction.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY DISCLAIMS ALL LIABILITY ARISING FROM OR RELATED TO ANY TRANSACTION, INCLUDING BUT NOT LIMITED TO:
(i) FAILED, DELAYED, OR REJECTED TRANSACTIONS;
(ii) PRICE VOLATILITY OR MARKET MOVEMENTS;
(iii) ERRORS OR OMISSIONS BY THIRD-PARTY PROVIDERS;
(iv) NETWORK CONGESTION, BLOCKCHAIN FAILURES, OR TECHNICAL ISSUES; OR

CryptoUnity may display transaction-related data, balances, or estimates for informational purposes only and does not guarantee their accuracy or completeness.
All fiat-related transactions are processed exclusively by third-party providers and are subject to banking, payment, AML, KYC, and regulatory requirements.
CryptoUnity shall not be responsible for any losses arising from actions or omissions of third-party providers, including BitGo.
6.1 Fiat Handling
CryptoUnity does not hold, receive, safeguard, or control fiat funds belonging to users.
All fiat deposits, withdrawals, and related payment services are processed exclusively through third-party service providers, including BitGo Technologies LLC and/or regulated banking or payment institutions.
CryptoUnity is not a money transmitter, payment processor, or financial institution and does not operate or maintain bank accounts for user funds.
You acknowledge and agree that all fiat transactions are handled solely by third-party providers and are subject to their respective terms, compliance requirements, and operational procedures.
CryptoUnity shall not be responsible for any delays in payment processing, any fees charged by banks or payment providers, any rejected or reversed transactions, or any errors, failures, or omissions caused by third-party providers.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY DISCLAIMS ALL LIABILITY ARISING FROM OR RELATED TO ANY FIAT TRANSACTIONS.
6.2 Deposits
Deposits may be made using the methods made available within the Platform.
You acknowledge and agree that:
(i) deposits must originate from accounts held in your own name;
(ii) deposits from third parties may be rejected, frozen, or returned;
(iii) processing times are determined by third-party providers and may vary.
All deposits are subject to compliance, AML, KYC, and sanctions checks.
CryptoUnity does not guarantee any deposit processing times or availability.
Third-party providers may verify the availability of sufficient funds or crypto-assets prior to processing transactions.
6.3 Withdrawals
Withdrawals are processed exclusively by third-party providers and may be subject to identity verification, compliance checks, sanctions screening, and applicable operational procedures.
CryptoUnity does not control or guarantee withdrawal execution, timing, or availability.
Withdrawal processing times are determined solely by third-party providers and may include delays due to compliance reviews, operational factors, or external dependencies.
CryptoUnity shall not be responsible for any delays, failures, disruptions, or restrictions in withdrawal processing.
6.4 Transaction Execution
All crypto-asset transactions are executed exclusively by third-party providers, including BitGo.
CryptoUnity does not execute transactions, does not determine execution timing, and does not guarantee execution prices, liquidity, or availability.
Prices displayed on the Platform:
(i) may include spreads, markups, or fees;
(ii) are indicative and may not reflect actual execution prices;
(iii) do not constitute binding offers unless explicitly stated.
By submitting a transaction request, you make a binding offer to enter into a transaction, which may be accepted, rejected, or partially executed by the relevant third-party provider.
BitGo or other providers may:
(i) reject transactions;
(ii) partially execute transactions; or
(iii) adjust execution based on market conditions, liquidity, risk controls, or legal requirements.
BitGo acts as principal and may be the direct counterparty to transactions.

6.5 Irreversibility of Transactions
Crypto-asset transactions are generally irreversible.
Once a transaction has been initiated:
(i) it cannot be canceled, reversed, or modified; and
(ii) CryptoUnity has no ability to undo or alter such transaction.
You are solely responsible for verifying all transaction details prior to submission, including recipient address, amount, and network parameters.
Transactions executed by third-party providers may only be reversed or corrected where required by applicable law or determined by such providers under their own terms.
6.6 No Refund Policy
All executed transactions are final. Refunds, reversals, or adjustments are not guaranteed.
Any refunds or corrections are subject solely to the policies of third-party providers and applicable law.
CryptoUnity does not determine whether a transaction is erroneous and is not responsible for resolving transaction disputes.
If you believe a transaction is erroneous, you must contact the relevant third-party provider in accordance with their procedures.
CryptoUnity may, at its sole discretion, assist in communication but has no obligation to resolve such issues.
6.7 Failed Transactions
If a transaction fails due to technical issues, insufficient balance, compliance restrictions, or third-party provider failures, the outcome shall be determined solely by the relevant provider.
CryptoUnity shall not be liable for any losses, damages, or delays resulting from failed, delayed, or rejected transactions.
6.8 Limits and Restrictions
Account limits, transaction limits, and feature access may be imposed based on:
(i) verification status;
(ii) regulatory requirements;
(iii) internal risk policies; and
(iv) third-party provider rules.
CryptoUnity reserves the right to modify, restrict, or remove such limits at any time without prior notice.
6.9 Service Availability and Restrictions
The availability of the Platform and services may be restricted or unavailable in certain jurisdictions due to legal, regulatory, licensing, or operational reasons.
You represent and warrant that:
(i) you are not located in a restricted jurisdiction;
(ii) you are not subject to sanctions or restrictions; and
(iii) you are accessing the Platform on your own initiative.

7. Trading and Execution
All digital asset transactions available through the Platform are executed exclusively by third-party service providers, including BitGo Technologies LLC or its affiliates (“BitGo”).
CryptoUnity does not execute trades, does not act as a broker, dealer, exchange, trading venue, order matching system, or counterparty to any transaction, and does not determine execution prices, liquidity, or timing.
All transactions are executed pursuant to the applicable agreements between you and the relevant third-party provider, including the BitGo Electronic Trading Agreement and the BitGo Master Purchase Agreement (MPA), as may be updated from time to time.
YOU ACKNOWLEDGE AND AGREE THAT BITGO (OR THE RELEVANT THIRD-PARTY PROVIDER) ACTS AS PRINCIPAL AND IS THE SOLE COUNTERPARTY TO YOUR TRANSACTIONS.

CryptoUnity may receive compensation, rebates, or other economic benefits from third-party providers, including BitGo, in connection with your use of the Platform. Such arrangements do not increase the total amount payable by you beyond what is disclosed prior to transaction execution.

Prices provided through the Platform may include a spread, markup, or margin applied by third-party service providers and/or CryptoUnity.
Such spread:
(i) is embedded in the quoted price;
(ii) does not constitute a separately itemized fee unless otherwise disclosed; and

YOU REPRESENT AND WARRANT THAT YOU ARE NOT:
(i) A PERSON OR ENTITY SUBJECT TO U.S. SANCTIONS;
(ii) LOCATED IN A SANCTIONED JURISDICTION; OR
(iii) ACTING ON BEHALF OF ANY SUCH PERSON OR ENTITY.
ANY VIOLATION OF THIS SECTION MAY RESULT IN IMMEDIATE ACCOUNT TERMINATION AND REPORTING TO AUTHORITIES.
13. Suspension and Termination
CryptoUnity may, at its sole discretion and to the maximum extent permitted by applicable law, suspend, restrict, limit, or terminate your access to the Platform or any services at any time, with or without prior notice and for any reason.
Such actions may be taken, including but not limited to, where:
(i) you violate these Terms;
(ii) you provide false, inaccurate, or misleading information;
(iii) your account is associated with suspected fraudulent, unlawful, or abusive activity;
(iv) required by applicable laws, regulations, court orders, or regulatory authorities; or
(v) necessary for risk management, security, or operational reasons.
CryptoUnity may, at its sole discretion:
(i) freeze or restrict transactions;
(ii) limit access to specific features;
(iii) delay or block withdrawals; or
(iv) take any other action deemed necessary to comply with legal, regulatory, or compliance obligations.
Third-party providers, including BitGo, may independently suspend, restrict, or terminate access to their services in accordance with their own terms, policies, and procedures.
CryptoUnity shall not be responsible or liable for any actions taken by third-party providers, including any restrictions, suspensions, delays, or terminations of services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY SHALL NOT BE LIABLE FOR ANY LOSSES, DAMAGES, OR CLAIMS ARISING FROM OR RELATED TO ANY SUSPENSION, RESTRICTION, OR TERMINATION OF ACCESS.
13.1 Account Closure by User
You may request to close your account at any time, subject to the completion of any pending transactions, obligations, or compliance requirements.
You are solely responsible for withdrawing or transferring any assets through applicable third-party providers prior to account closure.
CryptoUnity does not hold or control any assets and shall not be responsible for any loss resulting from your failure to withdraw or transfer assets prior to account closure.
Account closure may be delayed or restricted where required by applicable law, regulatory obligations, or compliance procedures.
13.2 Account Closure by CryptoUnity
CryptoUnity may terminate your account at any time, with or without notice, in accordance with these Terms.
Where required by applicable law, you may be provided with a limited opportunity to withdraw your assets through applicable third-party providers prior to account closure.
CryptoUnity shall not be obligated to maintain your account, provide continued access, or support any transactions following termination.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY DISCLAIMS ALL LIABILITY ARISING FROM ACCOUNT TERMINATION, INCLUDING ANY LOSS OF ACCESS, DATA, OR OPPORTUNITY.
14. Customer Support and Complaints
CryptoUnity may provide customer support in relation to the Platform.
Such support may include assistance with account access, general guidance on Platform functionality, and coordination with third-party service providers where appropriate.
CryptoUnity does not provide support for, and is not responsible for, services performed by third-party providers, including but not limited to transaction execution, custody of assets, fiat processing, or identity verification decisions.
For issues relating to third-party services, you may be required to contact the relevant provider directly, including BitGo, in accordance with their applicable terms.
CryptoUnity acts solely as a communication facilitator and does not control, resolve, or adjudicate disputes relating to third-party services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY DISCLAIMS ALL LIABILITY ARISING FROM OR RELATED TO CUSTOMER SUPPORT, INCLUDING ANY DELAYS, OMISSIONS, OR FAILURE TO RESOLVE ANY ISSUE.
14.1 Formal Complaints
If you wish to submit a formal complaint regarding the Platform, you may contact CryptoUnity using the contact details made available within the Platform.
CryptoUnity may, at its sole discretion:
(i) acknowledge receipt of your complaint;
(ii) review the matter within a commercially reasonable timeframe; and
(iii) provide a response where appropriate.
CryptoUnity does not guarantee resolution of any complaint or outcome favorable to you.
Complaints relating to services provided by third-party providers, including BitGo, must be addressed directly to such providers in accordance with their procedures.
14.2 No Obligation to Provide Support
CryptoUnity is under no obligation to provide customer support, maintain support channels, or respond to inquiries.
Any support provided is offered on a best-effort basis and may be modified, limited, or discontinued at any time without notice.
14.3 Dispute Resolution Limitation
Any disputes, claims, or complaints arising out of or relating to third-party services must be resolved directly with the relevant provider.
CryptoUnity shall not be a party to, or liable for, any dispute between you and any third-party provider.
Any dispute between you and CryptoUnity shall be subject to the arbitration and dispute resolution provisions set forth in these Terms.
15. Risk Disclosure
DIGITAL ASSETS ARE HIGHLY VOLATILE AND INVOLVE A HIGH RISK OF LOSS. YOU MAY LOSE ALL OR SUBSTANTIALLY ALL OF YOUR FUNDS.
BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE, UNDERSTAND, AND AGREE THAT:
(i) YOU ARE SOLELY RESPONSIBLE FOR ALL RISKS ASSOCIATED WITH DIGITAL ASSETS;
(ii) YOU HAVE SUFFICIENT KNOWLEDGE AND EXPERIENCE TO UNDERSTAND SUCH RISKS; AND
(iii) YOU CAN AFFORD TO LOSE YOUR ENTIRE INVESTMENT.
CRYPTOUNITY DOES NOT HOLD OR CONTROL DIGITAL ASSETS AND SHALL HAVE NO RESPONSIBILITY OR LIABILITY FOR ANY ASSETS HELD BY THIRD-PARTY PROVIDERS, INCLUDING BITGO.
15.1 Market Risk
The value of digital assets may fluctuate rapidly and unpredictably.
You acknowledge that:
(i) prices may rise or fall significantly at any time;
(ii) past performance is not indicative of future results; and
(iii) digital assets are not backed by any government or central authority.
Market conditions may be affected by factors including supply and demand, market sentiment, speculation, regulatory developments, and technological changes.
15.2 Execution and Pricing Risk
All transactions are executed by third-party providers, including BitGo.
Execution prices may differ from quoted or expected prices due to volatility, liquidity constraints, delays, or technical issues.
Pricing may include spreads or markups and may differ from prices on other platforms.
CryptoUnity does not control execution or pricing and shall not be liable for any losses arising from execution discrepancies, slippage, delays, or failures.
15.3 Third-Party Risk
The Platform relies on third-party service providers, including BitGo and payment providers.
You acknowledge that such providers may:
(i) suspend, restrict, or terminate services;
(ii) delay, reject, or block transactions; and
(iii) experience outages, failures, or disruptions.
CryptoUnity does not control and is not responsible for the performance, availability, or actions of any third-party provider.
15.4 Technology and Security Risk
Digital assets rely on blockchain and internet-based technologies that may be subject to failures, vulnerabilities, or attacks.
Risks include, without limitation:
(i) system outages;
(ii) network failures;
(iii) cyber-attacks or hacking;
(iv) unauthorized access;
(v) software bugs or protocol changes; and
(vi) irreversible transactions.
CryptoUnity does not guarantee uninterrupted, secure, or error-free operation of the Platform.
15.5 Regulatory and Legal Risk
The regulatory environment for digital assets is evolving and uncertain.
Changes in laws, regulations, or regulatory interpretations may:
(i) restrict or prohibit access to services;
(ii) impact pricing, liquidity, or availability; or
(iii) require suspension or termination of services.
CryptoUnity shall not be liable for any losses resulting from regulatory actions or changes.
15.6 Liquidity and Delisting Risk
Certain digital assets may have limited liquidity.
Third-party providers may suspend trading, restrict availability, or delist assets at any time, with or without notice.
Such actions may result in inability to transact, delays, or loss of value.
15.7 User Responsibility
You are solely responsible for:
(i) evaluating whether any transaction is appropriate for you;
(ii) making your own investment decisions; and
(iii) conducting independent research.
CryptoUnity does not provide investment advice and does not guarantee any outcomes.
15.8 Security and Fraud Risk
You are responsible for maintaining the security of your account and credentials.
Risks include unauthorized access, phishing, social engineering, and fraud.
Transactions are generally irreversible.
CryptoUnity shall not be liable for losses resulting from unauthorized access, except where required by applicable law.
CryptoUnity will never request your password, private keys, or sensitive credentials, nor request transfers outside the Platform.
15.9 No Guarantees
CryptoUnity makes no representations or warranties regarding:
(i) profitability or performance of digital assets;
(ii) availability or reliability of the Platform; or
(iii) successful execution of transactions.
The Platform may experience outages, delays, or technical issues.

Additional risks may exist, and you should seek independent professional advice where appropriate.

CryptoUnity does not provide investment, financial, legal, or tax advice.
NO CONTENT, FEATURE, OR FUNCTIONALITY PROVIDED THROUGH THE PLATFORM CONSTITUTES:
(i) INVESTMENT ADVICE;
(ii) A RECOMMENDATION;
(iii) A SOLICITATION; OR
(iv) AN OFFER TO BUY OR SELL ANY SECURITY.
YOU ARE SOLELY RESPONSIBLE FOR YOUR DECISIONS AND SHOULD SEEK PROFESSIONAL ADVICE BEFORE MAKING ANY FINANCIAL DECISIONS.
16. Tax Obligations
You are solely responsible for determining, reporting, and fulfilling any tax obligations arising from your use of the Platform and any transactions involving digital assets or fiat funds.
CryptoUnity does not provide tax advice and does not calculate, report, withhold, or remit any taxes on your behalf, except where required by applicable law.
You acknowledge and agree that:
(i) you are responsible for reporting all applicable transactions, gains, losses, and income to the relevant tax authorities; and
(ii) you must comply with all applicable tax laws and regulations in your jurisdiction, including U.S. federal, state, and local tax requirements.
Transactions conducted through third-party providers, including BitGo, may be subject to separate tax reporting obligations imposed by such providers.
CryptoUnity makes no representations or warranties regarding the tax treatment of any transaction or the accuracy of any tax-related information provided through the Platform.
YOU SHOULD CONSULT AN INDEPENDENT TAX ADVISOR REGARDING YOUR SPECIFIC TAX SITUATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY DISCLAIMS ALL LIABILITY ARISING FROM OR RELATED TO YOUR TAX OBLIGATIONS OR ANY FAILURE TO PROPERLY REPORT OR PAY TAXES.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRYPTOUNITY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR CLAIM ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE PLATFORM OR ANY SERVICES.
WITHOUT LIMITING THE FOREGOING, CRYPTOUNITY SHALL NOT BE LIABLE FOR ANY LOSSES ARISING FROM OR RELATED TO:
(i) DIGITAL ASSET TRANSACTIONS EXECUTED BY THIRD-PARTY PROVIDERS, INCLUDING BITGO;
(ii) PRICING, EXECUTION, SETTLEMENT, OR FAILURE OF TRANSACTIONS;
(iii) CUSTODY, LOSS, THEFT, OR INACCESSIBILITY OF ASSETS HELD BY THIRD PARTIES;
(iv) DELAYS, INTERRUPTIONS, ERRORS, OR FAILURES OF THIRD-PARTY SERVICES;
(v) INACCURACIES, DELAYS, OR OMISSIONS IN ANY INFORMATION DISPLAYED ON THE PLATFORM;
(vi) UNAUTHORIZED ACCESS, SECURITY BREACHES, OR ACCOUNT COMPROMISE;
(vii) MARKET VOLATILITY, PRICE FLUCTUATIONS, OR LIQUIDITY CONSTRAINTS; OR
(viii) ANY ACTION OR OMISSION OF THIRD-PARTY PROVIDERS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, BUSINESS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOUNITY’S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF:
(i) THE TOTAL AMOUNT OF FEES PAID BY YOU TO CRYPTOUNITY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
(ii) ONE HUNDRED U.S. DOLLARS (USD $100).
THE LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.
NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY:
(i) FOR FRAUD OR FRAUDULENT MISREPRESENTATION;
(ii) FOR WILLFUL MISCONDUCT; OR
(iii) WHERE SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.
YOU AGREE THAT ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES, OR SUCH CLAIM SHALL BE PERMANENTLY BARRED.
18. Complaint Resolution
CryptoUnity is committed to providing reliable customer support and resolving complaints in a fair, transparent, and timely manner.
18.1 How to Submit a Complaint
You may submit a complaint through the customer support chat available via the Platform, through the CryptoUnity Help Center accessible within your account, or by email at info@cryptounity.org.
For fraud-related issues, you must contact CryptoUnity immediately at info@cryptounity.org.
18.2 Acknowledgement and Response Time
Upon receipt of your complaint, CryptoUnity will acknowledge receipt within one (1) to three (3) business days and will provide a final response within thirty-five (35) business days.
If additional information is required or the matter is complex, response times may be extended. In such cases, you will be notified accordingly.
18.3 Escalation Process
If you are not satisfied with the response, you may escalate your complaint to CryptoUnity’s Compliance Team by contacting info@cryptounity.org.
Upon escalation, CryptoUnity will conduct an independent review and provide a final decision within thirty (30) business days of escalation.
18.4 Third-Party Services
Where your complaint relates to services provided by third-party providers (including BitGo), you may be required to resolve the matter directly with such provider in accordance with their applicable terms.
CryptoUnity may assist in coordinating communication but shall not be responsible or liable for the outcome of such complaints.
Complaints relating to execution errors, erroneous transactions, transaction confirmations, account statements, or unauthorized access relating to BitGo services must be submitted directly to BitGo in accordance with BitGo’s applicable terms and timelines.
You acknowledge and agree that communications relating to third-party services may be routed through CryptoUnity, which may forward such communications to the relevant provider and relay responses back to you.
BitGo and other third-party service providers may contact you directly where required for operational, legal, or regulatory purposes.
18.5 Alternative Dispute Resolution
If you remain dissatisfied after completing the complaint process, you may seek resolution through alternative dispute resolution (ADR) mechanisms available in your jurisdiction or through competent consumer protection authorities.
Nothing in these Terms shall limit your right to bring a claim before a court of competent jurisdiction.
CryptoUnity encourages users to first attempt to resolve disputes through its internal complaint handling process before pursuing external remedies.
19. Third-Party Services
The Platform relies on third-party service providers, including BitGo, for certain services.
CryptoUnity does not control and shall not be responsible or liable for the availability, accuracy, reliability, performance, or actions of any third-party service providers.
You acknowledge and agree that all transactions, including execution, pricing, settlement, and custody of crypto-assets, are carried out by third-party providers, and that any claims relating to such services must be directed to the relevant third-party provider in accordance with their applicable terms.
CryptoUnity makes no representations or warranties, express or implied, regarding any third-party services, including their availability, accuracy, reliability, or performance.
To the maximum extent permitted by applicable law, CryptoUnity disclaims all liability for any losses, damages, or claims arising out of or in connection with the use of, or reliance on, any third-party services.
Third-party providers may impose additional terms, conditions, fees, and restrictions, which you agree to comply with when using such services.
Your use of third-party services is at your own risk.
20. Data Protection and Privacy
Your personal data is processed in accordance with the CryptoUnity Privacy Policy, which is incorporated into these Terms by reference.
You acknowledge and agree that CryptoUnity may collect, use, and share your personal data and account information with third-party service providers, including BitGo, as necessary to provide the Platform, perform identity verification (KYC), anti-money laundering (AML) checks, fraud prevention, and to comply with applicable legal and regulatory requirements.
Where services are provided by third-party providers (including BitGo), your personal data may be processed by such providers in accordance with their respective privacy policies, terms, and regulatory obligations.
CryptoUnity and such third-party providers act as independent data controllers (or, where applicable, processors) with respect to their respective processing activities.
You acknowledge and agree that your personal data may be transferred to, stored in, and processed in jurisdictions outside of your country of residence, including the United States, where data protection laws may differ from those in your jurisdiction.
CryptoUnity implements appropriate technical and organizational measures designed to protect your personal data; however, no system can be guaranteed to be fully secure.
To the maximum extent permitted by applicable law, CryptoUnity shall not be liable for unauthorized access to, or loss, alteration, or disclosure of your personal data, except where required by applicable law.

21. Changes to These Terms
CryptoUnity reserves the right, at its sole discretion, to modify or update these Terms at any time.
Where required by applicable law, CryptoUnity will provide notice of material changes in advance, which may be communicated through the Platform, by email, or by other reasonable means.
The updated Terms will become effective as of the date specified in the notice.
Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of such changes.
If you do not agree to the updated Terms, you must discontinue use of the Platform.
22. Governing Law and Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles.
To the maximum extent permitted by applicable law, any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, United States.
Nothing in this Section shall limit any rights you may have under applicable consumer protection laws, including the right to bring claims in your country of residence where such rights cannot be waived.
23. Arbitration and Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
You agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or any services provided shall be resolved exclusively through binding arbitration, rather than in court, except as otherwise required by applicable law.
The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
The arbitration shall be conducted by a single arbitrator, in English, and may take place remotely or in a mutually agreed location.
Each party shall bear its own costs, except as otherwise required by applicable law or determined by the arbitrator.
YOU AND CRYPTOUNITY AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.
This arbitration agreement shall survive termination of these Terms.
24. Intellectual Property
All content, materials, trademarks, service marks, logos, software, and other intellectual property made available on or through the Platform (collectively, the “Content”) are owned by CryptoUnity or its licensors and are protected by applicable intellectual property laws.
Subject to your compliance with these Terms, CryptoUnity grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Platform and Content solely for your personal, non-commercial use.
You may not, without prior written consent of CryptoUnity or the applicable rights holder:
(i) copy, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, or otherwise exploit any Content;
(ii) reverse engineer, decompile, or attempt to extract the source code of any software;
(iii) remove, alter, or obscure any proprietary notices or labels; or
(iv) use any trademarks, service marks, or trade names of CryptoUnity.
All rights not expressly granted to you under these Terms are reserved by CryptoUnity and its licensors.
25. Indemnification
You agree to indemnify, defend, and hold harmless CryptoUnity, its affiliates, officers, directors, employees, agents, partners, and service providers (including BitGo) from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
(i) your use of or access to the Platform;
(ii) your violation of these Terms;
(iii) your violation of any applicable law, regulation, or third-party rights;
(iv) any content, data, or information submitted or transmitted by you; or
(v) your misuse of the Platform or any third-party services.
CryptoUnity reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with such defense.
You may not settle any claim without CryptoUnity’s prior written consent if such settlement imposes any liability or obligation on CryptoUnity.
26. Force Majeure
CryptoUnity shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from events beyond its reasonable control, including, without limitation, natural disasters, acts of God, cyber-attacks, system failures, power outages, internet or telecommunications disruptions, labor disputes, war, terrorism, civil unrest, or governmental or regulatory actions.
In such circumstances, CryptoUnity’s obligations shall be suspended for the duration of the force majeure event, and CryptoUnity will use commercially reasonable efforts to resume performance as soon as practicable.
27. Complaint Handling
Users may submit complaints relating to services accessible through the Platform, including services provided by third-party providers such as BitGo.
CryptoUnity will acknowledge receipt of complaints without undue delay and will handle complaints in accordance with applicable legal and regulatory requirements.
Where a complaint relates to services provided by a third-party provider (including BitGo), such complaint may be forwarded to the relevant provider for resolution in accordance with their applicable terms.
CryptoUnity may assist in coordinating communication but shall not be responsible or liable for the outcome of such complaints.
A response will typically be provided within fifteen (15) business days and, in complex cases, within thirty-five (35) business days.
28. Miscellaneous
These Terms, together with the Privacy Policy, Cookie Policy, and any other documents incorporated by reference, constitute the entire agreement between you and CryptoUnity regarding your use of the Platform and supersede all prior or contemporaneous agreements, communications, and understandings.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
The failure of CryptoUnity to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
CryptoUnity shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including force majeure events, cyber-attacks, system failures, regulatory or governmental actions, telecommunications or network disruptions, or failures of third-party service providers.
CryptoUnity may assign or transfer its rights and obligations under these Terms, in whole or in part, without restriction. You may not assign or transfer your rights or obligations without the prior written consent of CryptoUnity.
CryptoUnity reserves the right, at its sole discretion, to modify, suspend, or discontinue any part of the Platform or Services at any time, with or without notice, unless otherwise required by applicable law.
29. DMCA Policy
If you believe that any content on the Platform infringes your intellectual property rights, you may submit a notice pursuant to the Digital Millennium Copyright Act (DMCA) by contacting CryptoUnity at info@cryptounity.org.
Your notice must include:
(i) identification of the copyrighted work;
(ii) identification of the allegedly infringing material;
(iii) your contact information;
(iv) a statement of good faith belief; and
(v) a statement under penalty of perjury that the information is accurate.
CryptoUnity may remove or disable access to allegedly infringing content at its sole discretion.
30. Effective Date and Acceptance
These Terms become effective upon your acceptance during the registration process or upon your first access to or use of the Platform, whichever occurs first.
By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
These Terms will remain in effect until your account is closed and all obligations arising from your use of the Platform have been fulfilled.
CryptoUnity may update these Terms from time to time. Where required by applicable law, you will be notified of material changes. Your continued use of the Platform after such updates become effective constitutes your acceptance of the revised Terms.
